A team of experts from the International Atomic Energy Agency (IAEA) has concluded a Sub-Regional Workshop on Law for English-speaking African Member States in Cairo, Egypt. The event was hosted by the Government of the Arab Republic of Egypt through the Egyptian Nuclear and Radiological Regulatory Authority (ENRRA). This workshop followed previous workshops for English-speaking African Member States held in 2021 and 2017.

Held over four days from 22 to 25 July 2024, the workshop aimed at strengthening the national nuclear legal frameworks of African Member States and supporting their consideration of joining the relevant international legal instruments on nuclear safety, security, safeguards and liability.

Representatives from 16 African countries attended the event, fostering regional cooperation and providing an opportunity to exchange on issues, challenges, and opportunities in nuclear law, focusing on the international and national legal frameworks.

In his opening remarks, Samy Shaaban Attallah, ENRRA Chairman, highlighted, “Over the course of this workshop, we will delve into a myriad of topics, ranging from international conventions to national legislation, all aimed at fostering a safe and secure nuclear environment within Africa and beyond. The exchange of knowledge and expertise that will transpire in the coming days is not merely an intellectual exercise but a proactive step towards bolstering the effectiveness and implementation of nuclear legislative and regulatory frameworks within our respective nations.”

This event served as an important platform for dialogue, knowledge sharing, and strengthening of national legal frameworks in line with international legal instruments, standards and guidance. Several Member States requested bilateral meetings to identify their specific national needs in legislative assistance, including awareness raising for decision-makers, policy-makers and parliamentarians, reviews of draft and enacted nuclear legislation, national workshops on nuclear law and training in nuclear law such as the IAEA Nuclear Law Institute.

Daisy Mbugua, lawyer at Kenya’s Nuclear Power and Energy Agency, stated, “Kenya is committed to advancing its national nuclear legal framework, and this workshop on nuclear law marks a pivotal step in that journey, particularly in supporting our adherence to the relevant international treaties. By strengthening our national nuclear legal framework and aligning it with international legal instruments and standards, we are ensuring the safe, secure, peaceful and responsible use of nuclear energy for the benefit of the people of Kenya”.

On the margins of the Sub-Regional Workshop, a National Workshop was also held for decision-makers and high-level officials of the host country. Tamer Kamar, Head of the Legal Affairs Department at ENRRA, emphasized, “Egypt has benefited from the peaceful applications of atomic energy since the 1950s. Since more recently, we are introducing nuclear power for the first time, we are actively analyzing international conventions that we have not yet joined, including the Convention on Supplementary Compensation for Nuclear Damage, as well as the CPPNM and its Amendment. This event is particularly important as it provides a good opportunity to engage high-level decision-making officials on the subject of nuclear law with IAEA officials.”

The IAEA remains committed to supporting African Member States in developing or enhancing their nuclear law. A sub-regional workshop on nuclear law for Francophone countries is planned for November 2024 in C?te d’Ivoire.

The sub-regional workshop was conducted within the framework of the IAEA Legislative Assistance Programme under the Interregional Technical Cooperation Project for Legislative Assistance.

In response to a request for assistance from the Government of the Democratic Socialist Republic of Sri Lanka to discuss its draft amended nuclear law, a high-level delegation from Sri Lanka visited the IAEA Headquarters in Vienna, Austria, from 11-14 June 2024. This followed the IAEA Awareness Mission on Nuclear Law held in Colombo in November 2023. The main objective of the visit was to continue efforts to strengthen the country’s nuclear legal framework, in particular the Atomic Energy Act of Sri Lanka No. 40 of 2014 and to further support consideration of adherence to the relevant international legal instruments, in view of the country’s expected decision to embark on a nuclear power programme.

The high-level delegation included the Sri Lanka’s Resident Representative to the IAEA, M.R.K. Lenagala, A.K. Wickramasinghe, Additional Director, Ministry of Power & Energy, Hon. Justice Shobitha Rajakaruna, Judge of the Court of Appeal, Saminda Jayasekara, Chairman, Sri Lanka Atomic Energy Regulatory Council, K.K.P.I.K. Kadadunna, Director, Sri Lanka Atomic Energy Regulatory Council, K.S.S. Kumara, Deputy Director, Sri Lanka Atomic Energy Regulatory Council, Yuresha de Silva, Deputy Solicitor General, Attorney General’s Department, Malinda Ranaweera, Senior Scientific Officer, Sri Lanka Atomic Energy Board, Jagath Wickrmanayake, President’s Counsel (independent drafting expert) and Thilani Silva, Head of Legal Division, Ministry of Foreign Affairs.

Honorary Justice Shobitha Rajakaruna, Judge of the Court of Appeal said “We thank the IAEA for its continued support to and cooperation with Sri Lanka aimed at ensuring the country’s nuclear legal framework aligns with the relevant international legal instruments which we are already a party to and intend to join to support the safe, secure and peaceful development of the nuclear power”.

During the visit, IAEA staff and experts provided comments on the updated draft Amendment of the Atomic Energy Act covering the four areas of nuclear law, namely nuclear safety, security, safeguards and civil liability for nuclear damage. This collaborative effort was aimed at ensuring that the draft Amendment is consistent with relevant instruments, safety standards, and nuclear security guidance, and supports the establishment of a comprehensive national nuclear legal framework.

The Sri Lankan delegation also met with Lydie Evrard, IAEA’s Deputy Director General and Head of the IAEA Department of Nuclear Safety and Security, Hua Liu, Deputy Director General and Head of the IAEA Department of Technical Cooperation and Aline Des Cloizeaux, Director, Division for Nuclear Power of the Department of Nuclear Energy. In addition, the delegation visited the IAEA laboratories at Seibersdorf to gain first-hand knowledge of the IAEA’s work on nuclear applications.

In his opening remarks, Anthony Wetherall, Head of the Nuclear and Treaty Law Section in the IAEA Office of Legal Affairs, highlighted the significant progress made by Sri Lanka in developing the draft Amendment since last November’s mission.

This event was carried out within the framework of the IAEA Legislative Assistance Programme under the Interregional Technical Cooperation project for legislative assistance. The event was also conducted with the financial support of the extrabudgetary funds provided to OLA by the USA and with financial support provided through the Nuclear Infrastructure Development Section, IAEA Department of Nuclear Energy.

Sixty lawyers and regulators from 54 of the IAEA’s Member States are taking part in lectures and practical exercises covering all areas of nuclear law at a two-week intensive training course, known as the Nuclear Law Institute (NLI), currently underway in Vienna.

The participants are being trained on nuclear law in general as well as more specialized topics in the field, such as the legal aspects related to small and medium size reactors, nuclear safety and developments in nuclear fusion; the relationship between environmental law and nuclear law, and legal aspects regarding financing of nuclear decommissioning and waste management.

IAEA Director General Rafael Mariano Grossi highlighted the impact of global challenges, such as global warming, in elevating interest in nuclear energy and its applications. He also emphasized the importance of appropriate legislation for the applications of nuclear technologies, including those aimed to mitigate the effects of climate change. “You are participants of this course at a very crucial time in terms of nuclear activities,” he told attendees in his lecture on the future prospects of nuclear law.

The NLI was established 12 years ago, initiated by the IAEA as a response to the increasing demand for capacity-building in the field of nuclear law. Since then, the annual event, postponed in 2020 and 2021 due to the COVID-19 pandemic, has served as an arena to educate and support countries in the development of national nuclear legislation, covering all areas of nuclear safety, security, safeguards and civil liability for nuclear damage. This is the tenth session of its kind.

Highlighting that since 2011 around 600 officials have been trained through the Institute, IAEA Legal Advisor and Director of the Office of Legal Affairs Peri Lynne Johnson, said: “The NLI has made a major contribution to the establishment and enhancement of adequate national nuclear legal frameworks in Member States.”

The training course adopts a modern practice-based methodology, with lectures followed by facilitated group sessions in which participants partake in legislative drafting exercises with a senior legal or regulatory professional as ‘facilitator’, guiding them through in-depth discussions. In total, around 30 well-known experts in various aspects of nuclear law are presenting topics during the intensive two-week course.

“The purpose is to provide participants with an understanding of all relevant aspects of nuclear law as well as the practical experience of drafting, amending and reviewing national nuclear legislation,” said Johnson.

This week is the final week of the Institute, with sessions covering nuclear liability and insurance, safeguards and non-proliferation as well as special sessions on nuclear trade, legal framework for the management of transboundary nuclear risk, the relationship between environmental law and nuclear law, decommissioning and small modular reactors (SMRs).

At the end of the week, participant groups will present a draft national nuclear law under a hypothetical country profile, explaining each article in the legislation, followed by a plenary session of questions from the participants to the experts in the panel. “I am really looking forward to the remaining sessions and participating more in the FIG Group, which is the drafting group, and to presenting in the plenary forum about the draft law on Friday,” saidAlamgir Khan, Director of Legal Affairs of the Pakistan Atomic Energy Commission. “This two-week Nuclear Law Institute session is very informative and comprehensive, and has provided fundamental knowledge on nuclear law. It is an important project to facilitate Member States to prepare and develop national nuclear legislation.”

Hundreds of aspiring professionals stand to benefit from IAEA-supported programmes on nuclear law in Argentina, Brazil, Egypt, Jamaica, South Africa and the United Arab Emirates, following the signature of partnership agreements with universities in the six countries last week.

The agreements will help increase education and professional development opportunities for students and aspiring professionals in the field of international and national nuclear law.

“In nuclear law, the way people are introduced to the subject – whether they are introduced at all – will determine its future shape,” said Rafael Mariano Grossi, Director General of the IAEA, at the signing ceremony, which took place during the margins of the IAEA’s First International Conference on Nuclear Law: The Global Debate last week. “And in consequence, it will influence how the atom benefits future generations.”

The partnerships will help build awareness on nuclear law as a prerequisite for the safe, secure and peaceful applications of nuclear science and technology among operators, regulators, lawyers, engineers and policy makers; and to build teaching capacity in the field.

“When it comes to nuclear law there are too few opportunities for lawyers or engineering students to get exposed to something so essential for the nuclear field: the legal framework that is underlying all the activities,” said Imraan Valodia, Pro Vice-Chancellor of the University of Witwatersrand, South Africa. “We welcome the opportunity to collaborate with the IAEA to help our students and our faculty acquire additional resources in nuclear law education.”

Within this pilot cooperative framework, the IAEA will work with each institution to develop a series of courses and smaller modules focused on the four traditional branches of nuclear law – safety, security, safeguards and liability – to complement existing national or regional training activities in this field. The courses will be open to students from diverse academic backgrounds, including law, engineering, policy, and communications; smaller modules will be integrated into existing courses such as law, nuclear science and engineering. Upon successful completion of the academic requirements and an internship at a national regulatory body, operator, or relevant organizations, the students will receive a postgraduate certificate in nuclear law.

The initiative will be implemented within the framework of the IAEA Legislative Assistance Programme, which is supported by the Technical Cooperation Programme. Through the Legislative Assistance Programme, the IAEA supports governments in adhering to and implementing international legal instruments in the nuclear field and in developing corresponding national legal frameworks.

Nearly six years since entry into force of the 2005 Amendment to the Convention on the Physical Protection of Nuclear Material (CPPNM), the IAEA is hosting the first conference to review its implementation and its adequacy.

“We are gathered for a significant milestone in international nuclear security: for the first time the Parties to the Amendment to the CPPNM, now numbering 129, are reviewing the implementation and the adequacy of the only legally binding undertakings covering the physical protection of nuclear material and facilities,” said IAEA Director General Rafael Mariano Grossi in his opening remarks, reflecting on the importance of the Amendment to the Convention on the Physical Protection of Nuclear Material (A/CPPNM).

During the weeklong conference, the delegations of the A/CPPNM Parties will share their experiences in the implementation of the A/CPPNM, including steps taken to ensure robust physical protection of nuclear facilities and nuclear material, efforts taken to increase international cooperation, and actions implemented to criminalize offences involving nuclear material or facilities.

Side events organized on the margins of the Conference will also provide an opportunity for further discussion of different aspects of nuclear security and the Convention as amended. One of the side events, jointly organized by the IAEA and Canada, is specifically dedicated to the A/CPPNM universalization challenges and success stories.

The CPPNM currently has 164 Parties. There are still 35 Parties to the original Convention that have not yet joined the Amendment. Twenty-nine States have not yet joined the original Convention or the Amendment. “This conference is an opportunity to create momentum for further universalization. […] This conference is also an opportunity for Parties to underline their commitment to advancing nuclear security in general,” said Ambassador Benno Laggner of Switzerland, Co-President of the conference. Ambassador Suleiman Dauda Umar of Nigeria, Co-President of the Conference, added: “We hope that the purpose of nuclear power shall be limited to the peaceful uses and the economic development of Member States, and we also hope that most States will bring into force the A/CPPNM.”

Representatives from several international organizations and non-governmental organizations, approved by the Parties to the A/CPPNM to participate in the Conference, are present as observers.

Importance of the A/CPPNM

Countries all over the world use nuclear science and technology to meet their development objectives in areas including energy, health, food production, industry, water management, and environmental protection. The safety and security of the use of nuclear materials is at the forefront to prevent, detect and respond to potential incidents of theft, loss, illicit trafficking and other malicious acts. The CPPNM and its Amendment provide a framework for countries to work together to enhance nuclear security nationally, regionally and globally. The CPPNM as amended helps ensure that nuclear material and facilities are properly protected against malicious acts, and measures implemented by States to meet their obligations reduce the likelihood of malicious acts involving nuclear material and facilities.

“As nuclear is growing in importance and nuclear material becomes more prevalent, the world is changing. It is obvious for all of us that the atlas of opportunity and threat is being regrown in unpredictable ways and at unprecedented speed. It is in this context that the CPPNM as amended must serve its purpose. That means faster universalization of the A/CPPNM, faster implementation of the Treaty and its Amendment," said Mr Grossi.

Whereas the original CPPNM requires the physical protection of nuclear material used for peaceful purposes in international transport, the Amendment, which entered into force in 2016, expands the scope of the Convention to cover physical protection of nuclear facilities and nuclear material used for peaceful purposes in domestic use, storage and transport. The Amendment also adds to the list of criminal offences involving nuclear material and nuclear facilities covered under the Convention, and it strengthens the basis for international cooperation.

This first Conference to review the CPPNM as amended is supported by funding from the European Union and the Governments of Switzerland and the United States.

The crucial role of the IAEA

In addition to the role of the Director General of the IAEA as depositary of the Convention as amended, the IAEA also provides legislative and technical assistance to support States in adhering to and implementing the CPPNM and its Amendment, upon a State’s request.

The IAEA offers assistance in drafting and reviewing legislation, as well as peer reviews and advisory services on request, such as the International Physical Protection Advisory Service (IPPAS). It also offers e-learning courses to support countries in enhancing nuclear security. IAEA publications are also available to support countries in adhering to and implementing the provisions of the CPPNM as amended, including the Handbook on Nuclear Law, Volume I and Volume II, and the Nuclear Security Series.

The IAEA also holds an important role in promoting universal adherence to the CPPNM and its Amendment. In this regard, it conducts outreach activities, supports capacity building services and dedicates resources to increase awareness about the benefits of the CPPNM as amended.

As noted and reiterated by Mr Grossi today, the IAEA will continue its efforts by soon opening a Nuclear Security Training and Demonstration Centre for training on various topics of nuclear security.

Last year, the IAEA organized its first series of webinars on nuclear law for officials from around the world, attracting more than 2500 viewers from over 100 countries. Given the strong demand, the IAEA launched a webinar for the public last December.

A new series was launched last month, targeting nuclear professionals and lawyers interested in this specialized field. This series is divided into eight topics and is scheduled to run until May 2022.

The goal of this new series is to build on what was presented in last year’s webinars, and to explore some topical issues in depth. These topics relate, among others, to openness and transparency of information and stakeholder involvement in international and national nuclear law, the handling of radioactive sources, liability for nuclear damage and the potential impact on nuclear law of new technologies such as small modular reactors (SMRs).

“While the webinar series was a result of the pandemic and the cancellation of in-person activities, including the two-week Nuclear Law Institute (NLI) which is focused mainly on drafting nuclear legislation, it will remain part of the overall offering of the IAEA even once things return to normal after the pandemic”, said Peri Lynne Johnson, IAEA Legal Adviser and Director of the Office of Legal Affairs.

The first webinar, broadcast on 28 October, provided an update on nuclear law and encouraged participation in the entire series, including in the Q&A sessions following each webinar. The second webinar, held on 16 November, addressed the role of nuclear law in establishing the regulatory framework. The next session is scheduled for 2 December and will focus on nuclear law in the context of decommissioning and radioactive waste and spent fuel management.

What was your motivation for attending the webinar? What are the most relevant topics for you that this webinar or the series covers?

Lionel Rwamamara, Senior Legal Officer, Rwanda Utilities Regulatory Authority: “My motivation for registering for the webinar series is to acquire knowledge on basic concepts of nuclear law, which is a new field in my country. This will allow me to grasp its principles and further deepen my understanding about the nuclear industry as a Senior Legal Officer working for the regulatory body of nuclear radiation protection in my country.”

What kind of insights are you seeking from this webinar/series?

Haendra Subekti, Director for Regulation of Nuclear Installation and Materials, at the Indonesian Nuclear Energy Regulatory Agency (BAPETEN): “In principle, nuclear law should be the same in all countries, but national legal frameworks and their implementation are different. Given the new generation of small modular reactors (SMRs) technology and the theme of cross-border risk management, I would like to acquire the basic principles underlying the implementation and adaptation of international conventions to my country’s national legal frameworks.”

How can these webinars support you in your work? What kind of impact do the topics covered have on your work?

Ina Grigalashvili, International Legal Specialist, Georgia’s Agency of Nuclear and Radiation Safety: “The insights I get from the series have a direct positive impact on my everyday work. I am responsible for preparing the initiatives of acceding to the different international instruments of nuclear law. After Georgia became a party to the Convention on Assistance in the Case of a Nuclear Accident or Radiological Emergency, we are currently preparing the process for acceding to the Convention on Nuclear Safety. The steps described by the IAEA experts in this first webinar helped me to understand and potentially advocate for them to the decision makers in my country. The content of the webinars also offers new perspectives in my daily work when drafting a new comprehensive law for Georgia, which needs to be in full compliance with international obligations and commitments.”

What are your main take-aways from this first webinar?

Christopher Ng, Legal Counsel and Acting Head of the Legal Division, Safety, Health and Environment National Authority, Brunei Darussalam: “It was excellent to have a recap of the important aspects in the areas of nuclear security, safeguards and safety from the Office of Legal Affairs. Nuclear law does not operate in isolation and has cross-applicability in many areas including maritime law, environmental law, anti-terrorism law and so on and so forth. There is a need to examine other perspectives as to how nuclear law contributes to the already existing framework for international law. Legal advisors in regulatory bodies play an important role in bridging the technical and legal aspects of activities such as law-drafting. There is a need for more open exchanges and forums to learn from each other how to excel in these skills.”

Building on last year’s series of interactive webinars, the IAEA is launching a new series of webinars focused on topical issues in nuclear law. Starting on 28 October 2021, the first webinar will introduce the series and provide an update on nuclear law.

“Given the ongoing challenges of the global pandemic and travel disruptions, we continue to support Member States, upon request, through virtual national and regional workshops, as well as virtual bilateral discussions on draft legislation,” said Peri Lynne Johnson, IAEA Legal Adviser and Director of the IAEA Office of Legal Affairs. “This new series builds on last year’s series by providing a deeper perspective of topical nuclear law issues, such as openness and transparency, SMRs (small modular reactors) and nuclear law, as well as radioactive sources and liability for damage.”

This new webinar series is open to government officials with a policy, legal, regulatory or technical background from all IAEA Member States. It will be particularly beneficial for officials from countries participating in the IAEA Technical Cooperation Programme that are not party to some or all of the relevant international legal instruments adopted by or under the auspices of the Agency.

The series, which is being implemented within the framework of the IAEA Legislative Assistance Programme, will also benefit countries in the process of strengthening their existing national nuclear legislative frameworks.

The assistance programme creates awareness among IAEA Member States of the international instruments in the nuclear field and assists them in complying with their international obligations and commitments, as well as with the drafting of corresponding national nuclear legislation. Further to the postponement of the annual Nuclear Law Institute, this new webinar series serves as an online alternative.

Last year’s series, held from October to December, comprised nine webinars and was divided into three parts. The series covered the four main branches of international and national nuclear law: safety, security, safeguards and civil liability for nuclear damage. Government officials from over 100 countries attended the series, which amassed over 2500 streams. Following the series and in response to interest from various groups, including industry, law firms, civil society and academia, a public Webinar on Nuclear Law in Practice – the IAEA Perspective attracted more than 500 participants from 90 countries.

建立塞爾維亞核安全和核安保法律

There are many practical and peaceful applications of nuclear energy, and these processes yield by-products that need to be managed safely. Compliance with international standards regarding the management of spent nuclear fuel and radioactive waste increases safety globally, and over the last two decades, the IAEA has supported the efforts to achieve and maintain a high level of safety through the Joint Convention on the Safety of Spent Fuel Management and on the Safety of Radioactive Waste Management.

Twenty years ago, on 18 June 2001, the Joint Convention entered into force with 25 countries. Today, of the 173 IAEA Member States, 83 are party to the Convention. Congo is the most recent party to the Convention.

“While we celebrate, let us also strive to maximize its benefit by redoubling our effort towards making it universal,” said IAEA Director General Rafael Mariano Grossi in his video message about the Joint Convention.
